If you choose to retain the Molina Law Firm after the consultation, Attorney Rick Molina will file and serve a complaint and required documents. The party you are suing will be the defendants and you will be the plaintiff. The complaint will state the nature of the accident, injuries sustained, legal basis for holding the defendant at-fault and liable as well as the damages you are seeking. Once filed, the defendant will have the opportunity to answer the complaint.
Attorneys use pretrial motions and hearings to compel the other side to provide evidence but it can also be used to speed up, slow down or settle a case before it goes to trial. This is where summary judgements may be requested which simply means one side says the facts are undisputed and the party would like the judge to grant immediate relief.
If the parties cannot come to settlement, then the personal injury case will go to trial and file the lawsuit. In Texas, there is a 2 year statute of limitations for personal injury cases. The trial will determine if the jury believes the defendant was liable. If so, then the jury will determine the amount of damages awarded. As stated before, most personal injury cases are settled before a trial.
